Términos de uso

Vigentes desde el 2 de octubre de 2026

Estos términos son el acuerdo entre tú y SoftControl Enterprise Inc. («nosotros») para usar NextTalk. Al crear una cuenta los aceptas. Nuestra política de privacidad explica cómo tratamos los datos.

1. La cuenta

• Tu cuenta es un nombre de usuario. Las llaves de tu cuenta viven en tus equipos: guarda tu frase de recuperación en un lugar seguro. Si pierdes todos tus equipos y la frase, no podemos recuperar tu historial: no tenemos las llaves.
• Debes tener al menos 13 años, o la edad mínima que exija la ley de tu país.
• Eres responsable de lo que se haga desde tus equipos. Si uno se pierde, ciérrale la sesión desde otro.

2. Suscripción

• Descargar NextTalk es gratis. Para enviar mensajes, iniciar llamadas y usar el asistente hace falta la suscripción NextTalk Premium: USD 2.99 por mes (o el equivalente que muestre tu tienda en tu moneda, con impuestos según tu país).
• Prueba gratis de 30 días para cuentas nuevas de la tienda: no se cobra nada durante la prueba. Si no cancelas antes de que termine, empieza la suscripción paga.
• Renovación automática: la suscripción se renueva cada mes y se cobra a tu cuenta de Apple o Google en las 24 horas previas al fin de cada período, salvo que la canceles al menos 24 horas antes.
• La suscripción es por cuenta: pagar en un equipo sirve en todos los tuyos, Android o iPhone.
• Sin suscripción activa puedes seguir abriendo la app, leyendo, recibiendo, respondiendo llamadas y borrando tus mensajes; no puedes enviar mensajes a otras personas, iniciar llamadas ni usar el asistente.
• Podemos dar acceso gratis con códigos de regalo (gratis para siempre o por algunos meses). Un código no tiene valor en dinero, no se puede vender y puede tener fecha límite para canjearse.

Cómo cancelar

• iPhone: Ajustes → tu nombre → Suscripciones → NextTalk → Cancelar suscripción. También desde la App Store → tu foto → Suscripciones.
• Android: Google Play → tu foto → Pagos y suscripciones → Suscripciones → NextTalk → Cancelar suscripción.

Al cancelar conservas el acceso hasta el final del período ya pagado. Borrar la app o la cuenta no cancela la suscripción: cancélala en la tienda. Los reembolsos los decide la tienda según sus reglas (Apple: reportaproblem.apple.com; Google: desde el historial de pedidos de Google Play).

3. Uso aceptable

No uses NextTalk para: actividades ilegales; acosar, amenazar o suplantar a otras personas; enviar spam o mensajes masivos no deseados; distribuir material de abuso sexual infantil; difundir software malicioso; o intentar acceder sin permiso a cuentas o a nuestros sistemas, o sobrecargarlos. Puedes bloquear y reportar a cualquier persona desde la app. Podemos suspender o cerrar cuentas que incumplan estos términos o que la ley nos obligue a cerrar.

4. Tu contenido

Lo que envías es tuyo, y está cifrado: no lo leemos ni lo usamos. Tú eres responsable de lo que envías y de tener derecho a compartirlo. Puedes borrarlo para todos cuando quieras.

5. El servicio

Trabajamos para que NextTalk funcione siempre, pero se ofrece «tal cual» y puede tener interrupciones, cambios o errores. Las funciones pueden cambiar; si quitamos algo importante por lo que pagas, te avisaremos. El asistente es una ayuda para recordar: no lo uses como único aviso para medicación, emergencias o asuntos críticos.

6. Responsabilidad

En la medida en que la ley lo permita, no respondemos por daños indirectos ni por pérdidas de datos que dependan de tus llaves o equipos, y nuestra responsabilidad total queda limitada a lo que hayas pagado por NextTalk en los últimos 12 meses. Nada de esto limita los derechos que la ley de consumo de tu país no permite renunciar.

7. Fin

Puedes dejar de usar NextTalk y borrar tu cuenta cuando quieras. Si cambiamos estos términos publicaremos la nueva versión aquí con su fecha y te avisaremos en la app si el cambio es importante.

8. Ley aplicable y contacto

Estos términos se rigen por las leyes del Estado de Florida, Estados Unidos, sin perjuicio de las normas de protección al consumidor de tu país de residencia. SoftControl Enterprise Inc., 1568 NW 82nd Ave, Miami, FL 33126, USA. Contacto: support@nexttalk.app.

En iPhone también rige el Contrato de licencia estándar de Apple (EULA).

Terms of Use

Effective October 2, 2026

These terms are the agreement between you and SoftControl Enterprise Inc. ("we") for using NextTalk. By creating an account you accept them. Our Privacy Policy explains how we handle data.

1. Your account

• Your account is a username. Its keys live on your devices: keep your recovery phrase somewhere safe. If you lose all your devices and the phrase, we cannot restore your history: we do not have the keys.
• You must be at least 13, or the minimum age required by the law of your country.
• You are responsible for what is done from your devices. If one is lost, sign it out from another.

2. Subscription

• Downloading NextTalk is free. Sending messages, starting calls and using the assistant require the NextTalk Premium subscription: USD 2.99 per month (or the equivalent your store shows in your currency, with taxes as applicable in your country).
• 30-day free trial for new store customers: nothing is charged during the trial. If you do not cancel before it ends, the paid subscription starts.
• Auto-renewal: the subscription renews every month and is charged to your Apple or Google account within the 24 hours before each period ends, unless you cancel at least 24 hours before.
• The subscription is per account: paying on one device covers all of yours, Android or iPhone.
• Without an active subscription you can still open the app, read, receive messages, answer calls and delete your messages; you cannot send messages to other people, start calls or use the assistant.
• We may give free access through gift codes (free forever or for some months). A code has no cash value, may not be sold, and may have a redemption deadline.

How to cancel

• iPhone: Settings → your name → Subscriptions → NextTalk → Cancel Subscription. Or App Store → your photo → Subscriptions.
• Android: Google Play → your photo → Payments & subscriptions → Subscriptions → NextTalk → Cancel subscription.

When you cancel you keep access until the end of the period already paid. Deleting the app or your account does not cancel the subscription: cancel it in the store. Refunds are decided by the store under its rules (Apple: reportaproblem.apple.com; Google: from your Google Play order history).

3. Acceptable use

Do not use NextTalk for: illegal activity; harassing, threatening or impersonating others; spam or unwanted bulk messages; distributing child sexual abuse material; spreading malware; or attempting to access accounts or our systems without permission, or to overload them. You can block and report anyone from the app. We may suspend or close accounts that break these terms or that the law requires us to close.

4. Your content

What you send is yours, and it is encrypted: we do not read or use it. You are responsible for what you send and for having the right to share it. You can delete it for everyone whenever you want.

5. The service

We work to keep NextTalk running at all times, but it is provided "as is" and may have interruptions, changes or bugs. Features may change; if we remove something significant you pay for, we will tell you. The assistant is a memory aid: do not rely on it as the only reminder for medication, emergencies or critical matters.

6. Liability

To the extent permitted by law, we are not liable for indirect damages or for data loss that depends on your keys or devices, and our total liability is limited to what you paid for NextTalk in the last 12 months. Nothing here limits consumer rights that the law of your country does not allow to be waived.

7. Ending

You can stop using NextTalk and delete your account at any time. If we change these terms we will publish the new version here with its date and tell you in the app if the change is significant.

8. Governing law and contact

These terms are governed by the laws of the State of Florida, United States, without prejudice to the consumer protection rules of your country of residence. SoftControl Enterprise Inc., 1568 NW 82nd Ave, Miami, FL 33126, USA. Contact: support@nexttalk.app.
